Lansar Auto case: Mahamadane Sarr files 12th request for provisional release

Mahamadane Sarr, managing director of Lansar Auto, has been held in pretrial detention for 20 months in a case involving, among other charges, the use of forged public documents and alleged fraud involving public funds. His lawyers have filed a 12th request for provisional release, which is under review.

According to Me Moustapha Mbaye, one of his lawyers, the main steps expected in the investigation have reportedly already been completed. The defence believes the case has now slowed down and disputes the need to keep its client in detention.

The defence's position

The lawyer also raises objections concerning elements of the prosecution's case. According to him, the State Judicial Agent did not oppose the latest request for provisional release, while the Public Prosecutor's Office continues to oppose it.

The defence also raises the issue of responsibility in a case concerning, according to the prosecution, public funds. It believes the circumstances in which any irregular payments may have been made should be clarified, including the identification of possible co-perpetrators or accomplices.

Questions over the seized vehicles

Mahamadane Sarr's lawyers are also requesting a detailed inventory of Lansar Auto vehicles seized at the start of the proceedings. Information cited in the case file, according to the defence, suggests that some of these vehicles may have been put back into circulation or been subject to transactions under the authority of the National Office for the Recovery of Criminal Assets.

Me Moustapha Mbaye said the defence is considering formally approaching ONRAC to verify how these assets have been managed. It does not rule out taking legal action if irregularities are established.

Business affected, lawyers say

Lastly, the defence says the arrest of the executive and the seizures have severely disrupted Lansar Auto's operations. Workers reportedly stopped working, affecting their families. Mahamadane Sarr is still awaiting the judge's decision on his 12th application for provisional release.
