ASER case: Sunu 37 Billions Collective calls for a response before Senegalese courts

The Sunu 37 Billions Collective reacted in a statement to the position it attributes to José in the ASER case. The movement said it had taken note of statements by his lawyer, Me Patrick Kabou, according to which his client would no longer respond to requests from the Senegalese justice system and would instead favour proceedings initiated in Madrid.

For the collective, this choice cannot allow a person under investigation to select the jurisdiction before which they agree to answer. It calls for the Senegalese proceedings to take their course in compliance with the rules in force.

Legal steps cited in Senegal

In its statement, Sunu 37 Billions notes that José had previously taken several steps before Senegalese courts. The collective specifically mentions complaints targeting Seydou Kane and MP Thierno Alassane Sall, as well as proceedings before the Commercial Court concerning the use of AEE Power’s trademarks and logo.

It also refers to a case involving an alleged forged receipt and proceedings before an investigating judge, stating that these steps were allegedly abandoned or followed by a withdrawal. The collective sees this as inconsistent with the position now attributed to José regarding the Senegalese justice system.

Judicial and Financial Pool urged to act

The collective is asking the Judicial and Financial Pool to draw the legal consequences of the announced position, without prejudging the proceedings. It calls on the competent authorities to act with “firmness, speed and impartiality”.

Sunu 37 Billions also urges the justice system to examine all measures provided for by law, including, where appropriate, the possibility of an international arrest warrant. The movement believes that proceedings conducted abroad cannot, on their own, settle the questions or obligations that may exist in Senegal in the ASER 37 billion case.
